3.    TIHE SUPPLIER   OF  THE  GAS  SERVICE   SHALL   BE  RESPON BLE FOR  ORDINARY   MAINTENANCE  OF  GAS  MAINS  BUT   THE  OWNER SHALL   PAY FOR  DAMAGE  OR  RELOCATION  OF  SUCH   FACILITIES  CAUSED  OR  NECESSITATED  BY   ACTS   OF  THE   OWNER.   OR THE  OWNER’S  AGENTS   OR  CONTRACTORS.

4.   THE SUPPLIER  OF  GAS  SERVICE  SHALL  AT  ALL  TIMES HAVIE RIGHT  OF  ACCESS  TO  ALL  UTILITY  EASEMENTS  DEPICTED  ON THE  ACCOMPAtJYING  PLAT,  OR OTHERWlSE PROVIDED FOR IN  THIS DEED  or  DEDICATION. tOR   HiE  PURPOSE or INSTALUNG. REMOVING  OR  REPLACING  ANY  PORTION   OF  GAS  FACILITIES.

3.   NO  FENCE, WALL.  BUILDING OR OTHER OBSTRUCTION MAY  BE  PLACED  OR  MAINTAINED IN  THE DETENTION EASEMENT  AREA NOR  SHALL THERE BE  ANY  AL1ERATION OF  THE GRADES OR  CONTOURS IN  SUCH EASEMENT  AREA UNLESS  APPROVED BY THE DEPARTMENT OF PUBLIC  WORKS OIF   THE CITY OF TULSA,  OKLAHOMA.

 

4.   DETENTION. RETENTION  AND OTHER  DRAINAGE  FACILITIES  SHALL BE MAINTAINED  BY THE TRINITY  CREEK HOMEOWNERS’  ASSOCIATION, INC. (THE “HOMEOWNERS’  ASSOCIATION”) TO THE EXTENT NECESSARY TO ACHIEVE INTENDED  DRAINAGE,  RETENTION AND DETENTION FUNCTIONS,  INCLUDING REPAIR  OF  APPURTENANCES  AND REMOVAL  OF OBSTRUCTIONS  AND SILTATION,  AND  THE HOMEOWNERS’ ASSOCIATION  SHALL  PROVIDE   CUSTOMARY   GROUNDS  MAINlENANCE  WITHIN  THE  DETENTION  EASEMENT   AREA  IN  ACCORDANCE WITH  THE FOLLOWING  STANDARDS:

6.    IN  THE  EVIENT THE    HOMEOWNERS’ ASSOCIATION  SHOULD  FAIL  TO PROPERLY  MAINTAIN  THE  DETENTION,  RETENTION,  AND OTHER DRAINAGE  FACILITIES  OR IN  THE EVIENT OF  THE PLACEMENT  OF  AN  OBSTRUCTION ‘MTHIN,  OR  THE  ALTERATION OF THE GRADE OR CONTOUR ‘MTHIN THE DETENTION EASEMENT AREA, THE CITY OF TlULSA, OKLAHOMA OR ITS DESIGNATED CONTRACTOR  MAY ENTER AND PERFORM  MAINTENANCE  NECESSARY TO THE ACHIEVEMENT OF THE INTENDED  DRAINAGE  I’IUNCTIONS AND   MAY   REMOVE  ANY   OBSTRUCTION  OR  CORRECT   ANY   ALTERATION  OF  GRADF   OR  CONTOUR,  AND   THE  COST   THEREOF SHALL BE  PAID  BY  THE HOMEOWNERS’ ASSOCIATION.
